Terms & Conditions 

1. Mission Statement

Our mission is to be the number one brand in Indian Inspired Confectionery, by providing our customers with sensational tasting products and an excellent level of customer service.

2. Contract Agreement

 By placing an order through this website, either directly yourself or through one of our customer services team over the telephone, you are agreeing to the following terms and conditions:

All of our products either contain nuts or may contain traces of nuts.

Most of our products also contain soya, dairy and gluten.

Our Cakes contain Milk, Wheat and traces of nuts.
4. Price

4.1 The prices payable for products that you order are as set out in our website, discounts may be available for multiple product orders.

4.2 You will be required to pay extra for some delivery services and it might not be possible for us to deliver to some locations. Our delivery charges are set out during the order process.


5. Availability

All products are subject to availability. Although extremely rare, in the event of any supply difficulties, we reserve the right to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality.  Where this is necessary, we will try to contact you via email or telephone.  If you wish to discuss the substitution we have made, please contact our customer services on 0800 612 2040.


6. Payment

All orders are processed by SagePay or PayPal to ensure that you enjoy maximum security and peace of mind when making payment online.

We accept PayPal and the following credit/debit cards:
MasterCard
Visa
Maestro/Solo
Electron/Delta 

Payment will be processed at the time of order. The name and billing address given must be the same as the registered name and address of the cardholder. Failure to supply correct details may result in your order being delayed until you supply the correct details. In accordance with the standing Consumer Protection Distance Selling Regulations (2000) we will mail you details of your order and confirmation details of payment.


7. Delivery

7.1 Delivery is normally within 1-3 working days. If your order is for a special occasion, a Birthday for example, please inform us of that date and we will do everything possible to effect delivery on or just prior to that date. This is not guaranteed and we cannot accept responsibility for late deliveries as a result of the failure of the delivery service.

7.2 We will deliver the products ordered by you to the address you give us for delivery at the time you make your order. It is, however, your responsibility to provide us with accurate delivery address details. We will not check or verify addresses and messages supplied by you.

7.3 U.K. deliveries with the exception of cakes and large volume orders are made by Royal Mail 1st Class Postal Service, Royal Mail Recorded 1st Class postal service or Royal Mail Special Delivery service. Cakes are delivered by specialist courier. International deliveries are made by DPD or Interlink Express.

7.3 Our products are delivered in a rugged outer cardboard carton or padded packets to ensure that our products reach their destination in good condition. 

7.4 Please note that we are unable to deliver to an address containing a P.O. Box Number.

7.5 Should there not be someone in to accept delivery during working hours or if the Royal Mail considers that your order will not fit through the letter box a card will be left informing the recipient that they have tried to deliver. They will request that the recipient contacts their local sorting office to arrange collection or to re-deliver at a suitable date.

7.6 Once products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

7.7 We accept no liability if delivery is not made due to the recipient not being available or due to the recipient failing to contact their local Royal Mail sorting office within a reasonable time to arrange collection or re-delivery.

7.8 UK Delivery Area: United Kingdom includes Scotland, England, Northern Ireland and Wales.

7.9 International Delivery Area: Europe, America, Canada. 


8. Returns Policy

Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm

9. Cancellation


9.1 There will be no refund on cakes or other confectionery cancelled less than 5 days prior to collection or delivery.

9.2 We reserve the right to cancel the contract between us if
We do not deliver to your area; or
We have insufficient stock to deliver the products you have ordered. If this is the case, we will contact you to advise of an availability date or to offer you a substitute product;

One or more of the products you ordered was listed at an incorrect price due to a typographical error.

9.3 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.


10. Refunds

10.1 If you are in any way dissatisfied with our products please contact us immediately and return it by post within 3 days of the delivery and if possible in its original outer box so that we can arrange for either a re-send or a refund depending on the specific circumstances of the issue.

10.2 We comply with the standing Consumer Protection Distance Selling Regulations (2000). You may return any unopened non food items within seven working days from date of receiving it for a full refund.
Please note the refund value will equal the purchase price that you paid for the product.
 

11. Complaints
11.1 Corrections and repairs to cakes or barfi, including inscription mistakes, can be corrected on the same day in most cases. You are required to give us this opportunity and must let us know of the problem within one hour of accepting your cake/barfi.


11.2 Complaints are very rare and so we take them very seriously. Some complaints may require further investigation and an immediate refund may not always be possible.


11.3 Cakes, or part of cakes, must be returned within two days to ensure we are able to fairly assess the nature of the complaint. All other products must be returned within 3 days to ensure we are able to fairly assess the nature of the complaint.


11.4 The maximum refund we offer is the value of the product and delivery. Further compensation is not available.

 

12. Security & Privacy

12.1 We understand that security is a major concern for anyone purchasing goods online, therefore all Devnaa orders are processed by either SagePay or PayPal to ensure that you enjoy maximum security and peace of mind when making payment online.

12.2 Devnaa LLP does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfillment. In this case, the third party will not disclose any of the details to any other third party.

12.3 We conform to the requirements of the Data Protection Act, 1998.

12.4 Cookies are used on this shopping site to keep track of the contents of your shopping cart.

13. Gift Card Messages

13.1 We can include a message with your gift. This will be reproduced as you type it, directly onto the message card. 

13.2 We reserve the right to reject any message that we consider might offend the recipient for defamatory, racist, offensive, abusive, indecent, obscene, menacing or in breach of confidence, copyright or any other legal rights.

14. Intellectual Property & Website Use

14.1 The content of this website is protected by copyright, trademarks, database right and other intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on this website.

14.2 You are prohibited from using this website for any of the following purposes:

disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material or otherwise breaching any laws;
transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or codes of practice.
You are solely responsible for the content of any comments you make.

These Terms and Conditions do not affect your statutory rights.
